Wellborn SUD 2026 Impact Fee Update
Wellborn Special Utility District is updating its impact fee program to help ensure that new development contributes its fair share toward the cost of expanding water and wastewater infrastructure. Texas law (Chapter 395 of the Texas Local Government Code) requires the District to prepare certain planning documents and make them available for public review during this process. The materials posted at the link below include the District’s Capital Improvements Plan (CIP), growth assumptions, and the calculations used to determine proposed impact fees. These documents are provided so residents, property owners, and developers can review the information before the District considers adoption of the updated impact fees at a future public meeting.

2026 Impact Fee Update Process
During the last legislative session, significant changes were made to the process of updating an impact fee. The changes include additional waiting periods to allow public comment, additional industry representatives on the advisory committee, and a third-party audit of the existing impact fee program. We are among the first few entities in the state to follow the new procedure, so there were significant delays in arranging a third party to perform an audit. However - the audit is now complete, and the Capital Improvements Advisory Committee (CAIC) will soon meet with the District's consultants to review the planning documents posted above. Committee membership consists of two WSUD Directors and three local builders and developers, and they will be tasked with reviewing the calculations and issuing recommendations for the final impact fee order. In the coming weeks, the WSUD Board of Directors will adopt an order setting a date for a public hearing of the proposed impact fee, most likely in early June. Within 30 days of the public hearing, the WSUD Board must adopt or reject the update to the impact fee.
What is an impact fee?
Impact fees are one-time charges assessed on new development to help fund the water and wastewater infrastructure needed to serve growth. Under Chapter 395 of the Texas Local Government Code, these fees must be based on projected growth (Land Use Assumptions) and a Capital Improvements Plan (CIP) identifying the facilities needed to serve that growth. These planning documents form the basis for calculating impact fees and are provided for public review as part of the District’s impact fee update process.
Current WSUD Impact Fees:
Properties platted before 2017: $2,100 per connection
Properties platted after 2017: $5,923 per connection
